1. Rental Agreement The use of a rental contract is mandatory to ensure the security of both the host and the tenant. The contract must include: Identification of both parties (landlord and tenant). Duration of the lease. Payment terms and security deposit. Cancellation policies. Obligations and rights of the parties, such as the proper use of the property and its conservation. Clauses for the resolution of conflicts and/or non-compliance. It is recommended that this contract be drafted in Spanish or, failing that, that it be translated into Spanish. 2. Security Deposit Law No. 4314 establishes that it is valid to request a security deposit to cover possible damages to the property or breaches of the contract. This deposit must be returned at the end of the rental period if there are no damages or irregularities. 3. Registration of Foreigners and Visas If the tenant is a foreigner, it is essential to ensure that he/she complies with the Dominican Republic's immigration laws. Landlords must register foreign tenants with the Dirección General de Migración if their stay exceeds 30 days. 4. Safety and Maintenance Policies It is the owner's responsibility to ensure that the accommodation complies with current safety standards, which include: Fire prevention systems. Good condition of electrical and sanitary installations. Security measures such as secure locks and, in some cases, private security. In addition, the landlord should ensure that the accommodation is in optimal condition prior to the tenant's arrival by performing regular maintenance. 5. Cancellation Policies Cancellation policies must be clearly defined in the rental agreement or in the digital platforms used. Dominican law allows the parties to freely agree on cancellation conditions, as long as they are not abusive. 6. Legal Security and Dispute Resolution In case of disputes between the host and the tenant, the Real Estate Lease and Eviction Law (Law No. 4314) regulates the legal procedures regarding the eviction of tenants and the resolution of disputes for breach of contract. It is recommended that both parties first resort to mediation or arbitration to avoid lengthy court proceedings. 7. Data Protection Hosts operating through digital platforms must comply with the General Data Protection Law of the Dominican Republic. This includes the obligation to protect tenants' personal information and not to use it for unauthorized purposes.
